Terms of Service

These Terms of Service ("Terms") govern your use of Scout, a mobile and web application provided by Enjoyable, Inc. ("Enjoyable", "we", "us"). Please read them carefully. By creating an account or otherwise using Scout, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Scout.

Who can use Scout

Scout is intended for adults who are at least 18 years old and who are the parent or legal guardian, or another adult caregiver invited by a parent or guardian, of the children whose information is added to a Scout family. You represent that you meet these requirements. Scout is not directed to children, and children may not create accounts or use Scout.

Your account

You can create a Scout account using an email address or by connecting your Apple or Google account. You agree to provide accurate, current, and complete information, to keep your sign-in credentials confidential, and to be responsible for all activity that occurs under your account. You must promptly tell us at hello@scout.kids if you suspect unauthorized use of your account.

License to use Scout

Subject to these Terms, Enjoyable grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Scout for your own non-commercial, personal use. We may update or modify Scout at any time, and we may require you to install updates in order to keep using it.

Acceptable use

You agree not to:
  • • Use Scout in violation of any law, or to infringe anyone else's rights;
  • • Add information about another person, including a child, without having the legal authority to do so;
  • • Attempt to access another user's account or family;
  • • Reverse engineer, decompile, or attempt to extract the source code of Scout, except to the extent applicable law expressly permits;
  • • Interfere with, disrupt, or place an unreasonable load on Scout or its infrastructure, including by scraping, automating, or probing the service;
  • • Use Scout to transmit malware, spam, or other harmful or deceptive content; or
  • • Use Scout to commercially resell, sublicense, or redistribute its content or features.

Information you provide about your family

Scout lets you save information about your family, including names or nicknames and approximate ages of your children, an avatar for each profile, your home address, and the adults you invite to share your family. You represent that you have the legal right to provide this information and that doing so does not violate anyone else's rights. You can edit or remove this information at any time from within the app. We handle this information as described in our Privacy Policy.

Push notifications

With your permission, Scout can send you push notifications. You can turn notifications on or off from My Family or in your device settings.

Our intellectual property

Scout, including its software, designs, illustrations, content, and trademarks, is owned by Enjoyable or its licensors and is protected by U.S. and foreign intellectual property laws. These Terms do not grant you any right in our trademarks, logos, or trade dress, and you may not use them without our prior written permission.

Feedback

If you send us feedback, suggestions, or ideas about Scout, you grant Enjoyable a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into Scout and our other products and services, without obligation to you.

Third-party services and links

Scout uses services provided by third parties, including those listed in our Privacy Policy, to deliver features such as authentication, push notifications, maps, and place search. Scout may also link to or display content from websites and services we do not control. We are not responsible for the content, terms, or privacy practices of those third-party services, and your use of them is governed by their own terms and policies.

Termination and account deletion

You can stop using Scout and delete your account at any time from My Family > Delete account, or by emailing hello@scout.kids. Deleting your account removes your profile from your family; children and other adult caregivers in the family are not affected.
We may suspend or terminate your access to Scout, with or without notice, if you breach these Terms, if we are required to do so by law, or if continuing to provide the service to you would create a risk to Scout or other users. Sections that by their nature should survive termination will survive, including the sections on our intellectual property, feedback, disclaimers, limitation of liability, indemnification, and dispute resolution.

Disclaimers

Scout is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by law, Enjoyable disclaims all warranties, express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that Scout will be uninterrupted, secure, or error-free, or that any defects will be corrected.
Scout suggests activities and places. We do not endorse, operate, or verify those places, and you are solely responsible for the decisions you make about whether and how to participate. Always use your own judgment to keep yourself and your children safe.

Limitation of liability

To the maximum extent permitted by law, Enjoyable and its affiliates, officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of Scout, even if we have been advised of the possibility of such damages. Our total liability for all claims arising out of or related to Scout will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the limitations above will apply to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Enjoyable and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of Scout, or your violation of any law or the rights of any third party.

Governing law and disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. The federal and state courts located in King County, Washington will have exclusive jurisdiction over any dispute arising out of or relating to Scout or these Terms, and you and Enjoyable each consent to personal jurisdiction and venue in those courts.
Before filing a claim, please contact us at hello@scout.kids so that we can try to resolve the issue informally. Most concerns can be resolved that way.

Apple App Store additional terms

If you downloaded Scout from the Apple App Store, the following additional terms apply, and to the extent they conflict with the rest of these Terms, the following terms control as between you and Apple Inc.:
  • • These Terms are an agreement between you and Enjoyable, not with Apple. Apple is not responsible for Scout or its content.
  • • Your license to use Scout on an Apple-branded device is limited to a non-transferable license to use Scout on any Apple-branded devices that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  • • Apple has no obligation to provide maintenance or support for Scout.
  • • Apple is not responsible for any product warranties, whether express or implied. To the extent any warranty is not effectively disclaimed, Apple may, at your request, refund the purchase price (if any) for Scout. Apple has no other warranty obligation whatsoever.
  • • Apple is not responsible for addressing any claims by you or any third party relating to Scout, including product liability, consumer protection, or intellectual property claims.
  • • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Notice for California users

Under California Civil Code §1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give you reasonable notice in the app or by email before the change takes effect. By continuing to use Scout after a change takes effect, you accept the updated Terms. If you do not agree, you can stop using Scout and delete your account.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and Enjoyable about Scout, and they replace any prior agreement on the same subject. If any provision of these Terms is held to be unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
